Application for getting the permission from the Chief Executive to join the non-employee organization or group established outside the MSAR

2. Service procedures and required documents:

Service procedures:

(1) An application shall be made to the Labour Affairs Bureau by a representative designated by the trade union or trade union federation;

(2) The Labour Affairs Bureau shall submit a written opinion to the Chief Executive within 90 days from the date of receipt of the application;

(3) The Chief Executive shall make a decision on the relevant application after hearing the opinion of the Labour Affairs Bureau, which will notify the applicant of the decision within 8 days from the date of receipt of the decision;

(4) The applicant must join the relevant organization or group within 90 days from the date of receiving the permission notificationNote1.  Failure to join the relevant organization or group within the above period shall result in the expiration of the relevant permission.

Required documentsNote2 include:

(1) “Application form for getting the permission from the Chief Executive to join the non-employee organization or group established outside the MSAR” signed by a designated representative;

(2) Copy of the minutes of the general assembly meeting in which the resolution to join the relevant organization or group was passed;

(3) Information on the establishment or registration issued by the competent authority of the place where the relevant organization or group is located;

(4) Copy of the constitution setting out the objects of the relevant organization or group.

Notes:

Note 1: The trade union or trade union federation must notify the Labour Affairs Bureau within 30 days from the date of joining and submit information containing the trade union or trade union federation’s status or functions performed in the relevant organization or group.

Note 2: Documents must be made in any of the official languages of the MSAR; if the documents are made in any other language, a translation which is made in accordance with Articles 182 to 184 of the Notary Code must be provided, unless a translation is exempted from the Labour Affairs Bureau.
