Application for permission to exempt the office-holder from having the status of an employee

2. Required formalities and documentsNote 1:  

Formalities:

Under the following circumstances, the trade union or trade union federation must designate a representative to apply to the Labour Affairs Bureau for permission to exempt the office-holder from having the status of an employee:

(1) The office-holder does not have the status of an employee during the term of office, and the period does not exceed 180 consecutive days;

(2) The office-holder to be designated does not have the status of an employee.

Required documents include:

In the case that the office-holder does not have the status of an employee during the term of office and the period does not exceed 180 consecutive days, the following documents are required to be submitted:

(1) “Application for permission to exempt the office-holder from having the status of an employee” signed by a designated representative;

(2) Copy of documents proving the termination of the labour relation of the office-holder;

(3) The office-holder’s curriculum vitae;

(4) Supporting documents that prove the correlation between the office-holder and the trade union or the trade union federation, in particular to facilitate the operation of the trade union or the trade union federation (if any).

In the case that the office-holder to be designated (hereinafter referred to as “such person”) does not have the status of an employee, the following documents are required to be submitted:

(1) “Application for permission to exempt the office-holder from having the status of an employee” signed by a designated representative;

(2) Such person’s MSAR Resident Identity Card copy;

(3) Such person’s curriculum vitae;

(4) Such person’s certificate of criminal record

(5) “Declaration of having the appropriate qualifications to perform the functions of office-holders” completed and signed by such person;

(6) Supporting documents that prove the correlation between such person and the trade union or the trade union federation, in particular to facilitate the operation of the trade union or the trade union federation (if any).

4. Time required for processing:

60 days (counting from the date of receipt of application and all necessary documents)

 

Note:

Note 1: Documents must be made in any of the official languages of the MSAR; if the documents are made in any other language, a translation which is made in accordance with Articles 182 to 184 of the Notary Code must be provided, unless a translation is exempted from the Labour Affairs Bureau.
