Dispatch no. 49/GM/88, May 16

Importation of Skilled Workers

1. In the case of skilled workers, or of workers who, taking into account the conditions of the local labour market, are not normally available in Macau, the Governor may authorize, in accordance with Dispatch no. 12/GM/88, the rendering of services by non-resident workers; the custody of such workers shall be the responsibility of the employing entity.

2. The hiring of such workers shall follow the procedure mentioned in Dispatch no. 12/GM/88, with the following special rules:

a) The application of the interested entity, mentioned in paragraph 9 of Dispatch no. 12/GM/88, must:

a.1. provide a list of the individuals whose hiring is intended, together with a justification for that need, in accordance with paragraph 1;

a.2. enclose a draft of the intended rendering of services contract;

b) The application shall be processed with an opinion of the Labour Affairs Bureau, which, in this case, shall mainly address:

b.1. the possible availability of skilled resident labour for the work needs to be satisfied;

b.2. an analysis of the description of the functions of the professional categories of the workers to be hired, in order to enable a conclusion on their  correspondence to skilled professions;

b.3. the usefulness of hiring workers with the aforementioned skills for the purpose of possibly providing vocational training to resident workers;

b.4. an analysis of the stated hiring conditions, namely regarding the minimum necessary requirements, in accordance with sub-paragraph d) of paragraph 9 of Dispatch no. 12/GM/88;

c) the opinion of the Economic Services Bureau is not compulsory; however, opinions may be requested from other entities, namely the Macau Government Tourist Office in the case of hiring non-resident labour to work in the hotel industry or in similar industries;

d) Once the dispatch of authorization has been issued, the file shall be sent to the Commander of the Public Security Police Force, who shall decide on the authorization of entry and stay in the Territory of the listed workers.
